RUSH: El Paso Texas and David, a former Black Ops specialist here, great to have you on the program. David?

CALLER: Am I on, Rush?

RUSH: You're on. It's your big show biz break.

CALLER: Give me a break. Twenty years Marine Black Ops. Rush, I guess when we got Zarqawi we committed murder because we didn't knock on the door and issue him a warrant?

RUSH: Depending on if the right people in this country had gotten hold of the case you may not be joking.

CALLER: These gentleman now that are risking their lives in Black Ops, we're not lawyers and I'm not going to carry a subpoena and I'm not going to issue a warrant, and there's no reason for me to take these gentlemen back with me -- gentlemen -- these terrorists back with me.

RUSH: Yeah, that's interesting, these guys are all captured, they didn't just show up at Club Gitmo and give the credit card. They were captured and brought here.

CALLER: I am not going to put my men at risk to drag somebody back if I don't have room back in my boat, submarine. I'm not bringing them back. He's staying on the battlefield.

RUSH: Why?


CALLER: There's no reason for me to bring back a terrorist so he can stand trial.

RUSH: Interesting. You expect this to be an attitude that permeates many of your fellow colleagues?

CALLER: Exactly.

RUSH: So you're going to say, what's the point if I'm going to risk my life capturing these slobs and I bring 'em back and I get 'em in a sanctioned prison and all of a sudden wait a minute we can't treat them as prisoners or can't treat them as this we gotta treat them as American citizens and give them civil trials what's the point?

CALLER: I just saw two of my soldier Marines mutilated, beheaded, and booby-trapped, and they are telling me that I have to issue a warrant and knock on the door and say, "Please, put your hands above your head?" I don't think so. And this comes from a 20-year submariner, Rush.

RUSH: Well, what are your options, then? Let's say you're out there and this case is what it is, what are your options? You're not even going to pursue them, or you're going to pursue them and find them and take other measures?

CALLER: If my option was to bring back my men alive, get the information, and if I have somebody in my captivity to bring them back only, only, and it's always left up to me.

RUSH: So you have some leeway on this. Well, do you try to interrogate them before you eliminate them, under the circumstances, learn something from them?

CALLER: I'll give them five minutes, no.

RUSH: And they'll know it?

CALLER: Yes, sir.

RUSH: Yeah. Okay. Well, David, I appreciate the phone call. Once again a great illustration of the military effort being literally handcuffed here by a bunch of liberals wearing robes, no different than you and me, on the Supreme Court.
